Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the katcustomrings.com website (the “Site”) or purchasing goods from Kat Custom Rings (“we”, “us”, “our”). By accessing or using the Site or placing an order, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not access or use the Site or place orders.


1. Definitions & Scope

  1. “Customer” / “You” / “Your” refers to any person or entity who uses the Site, places an order, or communicates with us for services/products.

  2. “Goods” / “Products” / “Jewelry” refers to the items offered for sale by us, including custom and non-custom jewelry.

  3. “Order” means a purchase request placed by Customer via the Site (or offline if applicable).

  4. These Terms, together with our Privacy Policy, Return & Refund Policy, and any additional policies referenced herein, form the full agreement between you and Kat Custom Rings with respect to your use of the Site and purchase of goods.


2. Eligibility & Account

  • You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Site or place an Order.

  • By placing an Order, you represent that you have the legal capacity to enter into binding contracts.

  • You agree to provide true, accurate, current, and complete information when creating an account or placing an Order, and to maintain and promptly update it.


3. Orders & Acceptance

  • All Orders are subject to acceptance by us. We may refuse or cancel any Order for any reason (e.g. out of stock, errors in pricing or description, suspicion of fraud).

  • Your Order is accepted when we send you an order confirmation (e.g. via email), or when we ship the goods (whichever occurs first).

  • We reserve the right to make changes to product descriptions, prices, or availability at any time before Order acceptance.


4. Pricing & Payment

  • All prices are in USD and exclude taxes and shipping unless otherwise stated.

  • You are responsible for all applicable sales tax, duties, customs, or import charges in your jurisdiction.

  • Payment must be made via the methods offered on the Site. You authorize us to charge the full amount for the Order (including any deposits, balances, taxes, shipping) to your selected payment method.

  • For custom orders, we may require a non-refundable deposit before beginning work.

  • If payment fails (e.g. chargeback, insufficient funds), we may withhold shipment until the issue is resolved.


5. Custom / Personalized Orders

  • Custom orders (engraving, resizing, bespoke designs) may require you to approve designs, estimates, and timelines in writing (email or other).

  • Deposits for custom work may be non-refundable due to the irreversibility of certain design or material commitments.

  • You acknowledge that custom products may differ slightly from mockups or digital renderings (color, texture, finish) due to the nature of materials and production.

  • If you provide your own materials (e.g. gemstones, parts), you assume responsibility for their condition, risk in shipment, and suitability. We may refuse to use unsuitable materials.


6. Shipping, Delivery & Risk of Loss
  • We will ship goods to the address you specify. Titles and risk of loss pass to you when the item leaves our facility (i.e. when handed over to the carrier).

  • You are responsible for inspecting the package upon receipt. If damage or loss occurs in transit, you must notify us within [e.g. 48 hours] (and provide relevant supporting documents/photos).

  • We are not liable for delays in transit, customs hold-ups, carrier errors, or force majeure events outside our control.


7. Returns, Exchanges & Refunds

  • Our Return & Refund Policy governs all returns, exchanges, and refunds. Those terms are incorporated herein by reference.

  • Custom or personalized items are generally non-returnable unless there is a manufacturing defect or you received the wrong product.


8. Intellectual Property

  • All content on the Site (images, text, logos, designs, software, layout) is the property of Kat Custom Rings or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  • You may not copy, reproduce, distribute, modify, publicly display, or use any content from the Site except for your personal, noncommercial use or to place an Order.

  • If you submit custom designs, sketches, or ideas to us, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, or display them for purposes of design, marketing, or portfolio, unless otherwise agreed in writing.


9. Prohibited Uses & Conduct


You agree not to use the Site or Services to:
  • Violate any law, regulation, or third party rights (including intellectual property).
  • Submit false or fraudulent information, or impersonate any person or entity.
  • Interfere with or disrupt the Site, servers, or networks.
  • Use bots, scrapers, or automated tools to collect data or access content.
  • Post malicious code, viruses, or harmful content.
  • Use the Site for commercial resale, unless expressly permitted by us.


We may suspend or terminate your access for violations without liability to you.


10. Disclaimers, Warranties & Limitation of Liability

  • The Site and Goods are offered “as is” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, noninfringement).

  • We do not guarantee that the Site will be error-free, secure, or uninterrupted.

  • To the fullest extent permitted by law, Kat Custom Rings (and its officers, directors, employees, agents) will not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, loss of data, business interruption) arising from your use of the Site, Goods, or any breach of these Terms, even if advised of the possibility of damages.

  • In no event shall our total liability for any claim exceed the amount you paid for the particular Order giving rise to the claim.


11. Indemnification


You agree to indemnify, defend, and hold harmless Kat Custom Rings (and its officers, directors, employees, affiliates) from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Site or Goods in violation of these Terms;

  • Your violation of third-party rights;

  • Your negligence, gross negligence, or willful misconduct;

  • Any claim relating to custom designs or materials you provided.


12. Governing Law, Dispute Resolution & Venue

  • These Terms are governed by and construed under the laws of the State of Illinois, without regard to conflicts of law principles.

  • Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site or purchase of Goods shall be resolved by binding arbitration (unless you opt out) or in state/federal courts located in the jurisdiction of your billing address or Jackson County, Illinois (or a jurisdiction mutually agreed upon).

  • If arbitration, the arbitration will be conducted under the rules of a recognized arbitration provider (e.g. AAA or similar) and judgment on the award may be entered in any court having jurisdiction.

  • You have the right to opt out of arbitration within 30 days of placing your first Order by sending written notice to our contact address (provided below).

  • You and we irrevocably waive any trial by jury.


13. Changes to Terms


We reserve the right to update or modify these Terms at any time (e.g. for new features, legal requirements). When we do, we will post the revised Terms on the Site, indicate the “Last Updated” date, and it will apply to Orders placed after the update. Your continued use of the Site after changes means you accept the revised Terms.


14. Severability & Waiver

  • If any provision of these Terms is found invalid or unenforceable, the remainder shall continue in full force and effect.

  • Our failure or delay to enforce any right or provision under these Terms shall not constitute a waiver of that right.
